When you access our website, purchase our products or use our services, you establish a relationship with us and become a part of the Moonforest India family. These terms and conditions form a legal contract between you and Moonforest India. They are curated as much for your protection as they are for our business and so we encourage you to read these Terms and Conditions carefully before accessing our website, purchasing our products or using our services.

By using our Site or products or services, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not use our Site, or products or services.

DISCLAIMER:

• This website shall strictly be accessed by you for personal and non-commercial use only;
• By agreeing to these Terms and Conditions, you undertake that you are at least the age of majority and legally entitled to enter into contracts. You undertake to abide by the Terms and Conditions diligently and make use of our website, products, services, brand name, and all other related information therein, in good faith.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Moonforest India Website/Products/Services, use of the Moonforest India Website/Products/Services, or access to the Moonforest India Website/Products/Services or any contact on the website through which the service is provided, without express written permission by us.You agree to not use our products for any illegal or unauthorized purpose nor may you, in the use of the Moonforest India Website/Products/Services, violate any laws in your jurisdiction (including but not limited to copyright laws), to not transmit any worms or viruses or any code of a destructive nature.
• Your purchase with Moonforest India implies your agreement to these Terms and Conditions. Moonforest India advises you to do a “Patch Test” before using its each and every product.
• Moonforest India provides interactive services which may include beauty and skincare suggestions. Your adopting these services implies your agreement to these Terms and Conditions. Moonforest India provides these general suggestions which can have a different impact on people based on their different skin types.
• Moonforest India reserves the sole right to determine, fix and modify the prices of the products, subject to change without notice at any time.
• Moonforest India reserves the sole right to provide, continue or discontinue the service, or any part thereof, subject to change without notice at any time.

We reserve the right to accept or reject service to anyone for any reason at any time. This site is designed, updated and maintained by Moonforest India or its licensors. A breach or violation of any of these Terms and Conditions will result in an immediate termination of your Services with Moonforest India.

1. GENERAL CONDITIONS:

These Terms and Conditions constitute an “offer” and the “acceptance” is expressly limited to these Terms and Conditions. All products/services and information displayed on the Website constitute an “invitation to offer.” Your order for purchase constitutes your “offer” which shall be subject to these Terms and Conditions. We reserve the right to “accept” or “reject” your offer in part or in full. Once the dispatch of the products ordered by you takes place, the offer shall be deemed to be “accepted.”

Dispatch of all the product(s) ordered, may or may not happen simultaneously – in such a scenario that portion of the order which has been dispatched will be deemed to have been accepted by us and the balance would continue to be on offer to us and we reserve the right to accept or reject such balance order. No act or omission of Moonforest India prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer.

2. PRODUCT INFORMATION:

All information regarding the product composition is made available to the Customers on the website and on the packaging of the products. Moonforest India attempts to be as accurate as possible in the description of the products provided on the Website as well as on the packaging of the Products. However, Moonforest India does not warrant or guarantee that the product quality, colour, texture, consistency, description, etc. will always be accurate and consistent throughout every batch of every product.

The products at Moonforest India are as far as possible vegan, light weight and composed of non-greasy formula, they are mineral oil free, paraben free, synthetic dye free, cruelty free and alcohol free. All our products are free from toxic chemicals and are within a pH limit which is safe for skin. It involves use of 100% natural extracts and oils and are tested in-house and in the NABL Certified lab so as to attain the Bureau of Indian (BIU) standards.

However, since different skin types may react sensitively to some ingredients, it is recommended to take a small area of your skin and do a patch test and check how the skin reacts to the ingredients.

3. PURCHASE OF PRODUCTS:

Your purchase with Moonforest India is a simple 5-step procedure starting from adding your favourite products to the cart to receiving a confirmation e-mail/SMS from Moonforest India.

Step 1- Add your favourite products to the Moonforest India Shopping Cart on our Website.

Step 2 – Make an account with Moonforest India with your “Login ID” and “Password” and/or your mobile number and other necessary details asked for on the Website. Once you make an account with us, you will be a “Moonforest India Subscriber” and you will not need to add the details everytime you make a purchase with us. You will also be a registered Customer receiving emails and messages about our latest offers and updated services.

Step 3 – Provide shipping and billing details. It will be understood that the address details provided you shall be true and correct, Moonforest India does not take the responsibility of any wrong shipping and billing details provided by you to us.

Step 4 – Choose the required mode of payment from Debit Card, Credit Card, Net Banking, UPI mode of payment or Cash on Delivery (COD). You can also add the discount code and gift code (if any) here so as to avail reduction in the total price of your order.

Step 5 – Receive confirmation via E-mail and/or message on your registered mobile number regarding confirmation of your order. This confirmation shall state the details of the products, order number and payment details. Upon confirmation you will also receive e-mail and/or messages regarding the status and delivery progress of your Order from time to time.

Delivery:

The Products will be delivered within 7 days of placing the order with Moonforest India. and the courier service assigned for such delivery will be informed to you via email and/or message on the registered mobile number.

Quantity Restriction:

Moonforest India reserves the right to limit the number of items to be purchased per person, per household, or per order. We will notify you if such limits are applied.

4. RETURN/ EXCHANGE POLICY:

While returning a product, the Customers may either opt for ‘Exchange’ or ‘Return’. Moonforest India provides a return and exchange policy to all its Customers, for only those products that have been purchased from this Website. Additionally, our products can only be returned or exchanged if they qualify as being in ‘returnable condition’ or ‘exchangeable condition’ respectively (as the case may be) and only if-

• They are damaged/defective; or
• The Customer has been sent a product other than the one described in their Invoice; or
• The product has come to the Customer in a soggy, leaking, badly packed or tampered condition;

Return:

A Product shall be returned only if it qualifies as being in a ‘returnable condition’. We follow certain regulations when accepting return of products-

• Once the seal on the bottle of the product is opened, the product will not qualify for return;
• At the time of return, we require you to upload a photo/ video of the product along with the reason for return. Once Moonforest India approves the same as being in a ‘returnable condition’, you shall receive a email confirmation and/or message on the registered mobile number, which will be followed by a pick-up at the address of delivery;
• Moonforest India products can be returned only within 15 days, starting from the date of delivery;
• Along with the product, you will also be required to return all other items sent along with it.

Note: No return will be applicable on sale products or Moonforest India products purchased from other websites.

Exchange:

A Product shall be exchanged only if it qualifies as being in a ‘exchangeable condition’. We follow certain regulations when accepting exchange of products-

• Once the seal on the bottle of the product is opened, the product will not qualify for exchange;
• At the time of exchange, we require you to upload a photo/ video of the product along with the reason for exchange. Once Moonforest India approves the same as being in a ‘exchangeable condition’, you shall receive a email confirmation and/or message on the registered mobile number;
• Once Moonforest India accepts a product for exchange, the same will be replaced within 15 working days. The exchangeable product will be picked-up at the time of delivery of the new product.
• Along with the product, all other items sent along with it shall also be exchanged.

Note:

• Exchange of products is subject to availability. If the product for which exchange has been initiated is not in stock, Moonforest India will inform you about the same via email and/or message on the registered mobile number and initiate a refund process.
• No exchange will be applicable on sale products or Moonforest India products purchased from other websites.

5. REFUND POLICY:

Once Moonforest India accepts a product for return, an email will be sent to you regarding its confirmation and the refund will be reflected within 10 working days of Moonforest India receiving the product at their warehouse. All bank holidays shall be excused for the purpose of counting days for refund. In the event, any unforeseen circumstances arise and the refund is expected to take longer than 10 working days, the same shall be notified to the Customer via email and/or message on the registered mobile number.

If your mode of payment has been through Debit Card, Credit Card, Net Banking, UPI, then the refund amount shall be credited to your respective bank account within 10 working days. If your mode of payment has been through Cash on Delivery (COD), then in the confirmation email, Moonforest India will ask for your bank account details and once the same is provided, the refund amount will be credited to your respective bank account within 10 working days.

Note: Refund will only be made to the Bank account of the Customer.

6. CANCELLATION POLICY:

You can choose to cancel our products only before the dispatch of the products takes place.

Cancellation before dispatch: If the product has not been dispatched and you wish to cancel your order, you can do so from our Website. Here, if your mode of payment has been through Debit Card, Credit Card, Net Banking, UPI then the amount will be refunded to the respective bank account within 10 working days from the day the cancellation is made.

Cancellation after dispatch: No cancellation will be accepted once the products have been dispatched from our end.

7. USE OF SERVICES:

Moonforest India strives to serve the best interest of its customers by including and showcasing all its skincare research and knowledge under its different media platforms. Our services, amongst others, include interactive services such as beauty and skincare suggestions, tips, home remedies, steps and procedures, wellness routines, etc.

You can access the services of Moonforest India on a one-on-one basis through its Website, Instagram, Facebook, WhatsApp and also through Email communication.

Your adopting these services implies your agreement to these Terms and Conditions. Moonforest India provides these general suggestions which can have a different impact on people based on their different skin types.

8. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS:

All reviews, comments, feedback, testimonials, postcards, suggestions, ideas, and other submissions (for example contest entries), submitted to us on or by this Website or otherwise disclosed, submitted or offered in connection with your use (collectively, the “Comments”) shall be and remain our property. You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. Thus, we own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments.

We are and shall be under no obligation –

• Moonforest products are made with utmost care and precaution using natural and organic products. Every product is curated with its own unique composition keeping in mind the need of every skin type. To ensure transparency between you and Moonforest, each of our products provides sufficient details. Our products warrant a ‘disclaimer’ which must be read for your safe use of the product because it is possible that certain ingredients may cause allergic reactions to certain individuals or adversely affect individuals with pre-existing medical conditions.
• Our services and all products and services delivered by Moonforest to you are provided ‘as is and ‘as available for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.
• We do not guarantee, represent or warrant that your use of our products and services will be uninterrupted, timely, secure or error-free.
• We do not warrant that the results that may be obtained from the use of the product and service will be accurate or reliable.
• You agree that Moonforest India has the liberty to remove the product for indefinite periods of time or cancel the service at any time, without notice to you.

Without prejudice to the generality of the term above, our total liability to you for all liabilities arising out of these Terms and Conditions be it in tort or contract is limited to the amount charged to you, against the value of the products ordered by you.

11. USAGE RESTRICTIONS:

You are prohibited from using this website:

12. FORCE MAJEURE:

You understand and agree that Moonforest India will not be liable for any delay or failure to comply with its obligations or for non-performance of any of these Terms and Conditions caused, directly or indirectly, due to a Force Majeure event, including but not limited to a situation of a fire, flood, earthquakes, pandemics, epidemic, storms, natural calamities, trade restrictions, acts and orders of Courts or any other competent government authorities, inevitable accidents or any other causes beyond the control of Moonforest India.

If the delay or failure of performance of the obligations of Moonforest India is in any manner affected due to the occurrence and continuance of such Force Majeure Event then the period of performance of the obligations of Moonforest India towards you shall automatically stand extended for such period affected by such Force Majeure Event.

13. INDEMNIFICATION:

You agree to defend, indemnify and hold harmless Moonforest India and our founder, proprietors, partners, licensors, contractors, suppliers, dealers, agents, employees, service providers, and subsidiary companies from and against any and all claims, liabilities, damages, losses, costs and expenses, including Attorney’s fees, caused by claims arising out of your actions or inactions resulting from your use of the products and services of Moonforest India, breach of these Terms and Conditions, violation of any law or rights of the third party and/or use of data gathering and extraction tools.

This term shall survive the expiry or termination of these Terms and Conditions.

14. APPLICABILITY OF THESE TERMS AND CONDITIONS

You acknowledge and agree to these Terms and Conditions and that they form a complete and binding agreement between You and Moonforest India with respect to each purchase or each time you use our services and that they supersede and govern all prior proposals, agreements and other communications.

15. DISPUTE RESOLUTION:

Any disputes and differences arising out of or in connection with these Terms and Conditions, including any question regarding the existence, validity or termination of these Terms and Conditions and regarding the use of our Products, services shall be determined by arbitration, in Indore, Madhya Pradesh, in accordance with LegalRise Arbitration Rules of LegalRise Institution. A Sole Arbitrator shall be appointed by the Institution and the language of the arbitration shall be English.

All disputes under these Terms and Conditions shall be referred to institutional arbitration as per Arbitration & Conciliation Act, 1996 and shall not be subject to any Court proceedings.
